16. INDEMNIFICATION

    To the greatest extent allowed by North Carolina law, the participants shall indemnify, defend, and hold harmless the Town, its elected officials, employees, agents and assigns from and against all claims, losses, demands, lawsuits, costs, damages expenses, costs and attorney and legal fees, resulting from its participation in and with the operation of the Social District. If the performance of the participant under this Social District Plan or Ordinance or the administration of it shall be defective in any respect the participants shall indemnify and save harmless all claims allowed by law. Nothing in the Davidson Social District Plan or Ordinance shall waive the constitutional limitation of the Town indemnifying obligations of the other parties and neither does not constitute a waiver of the Town’s governmental immunity or limit the Town’s liability or damage created by Law.

    3. I agree to abide by the State of North Carolina laws and regulations and the Town of Davidson’s rules, regulations and ordinances and the conditions listed in this application should my application be approved, and I will fulfill the requirements placed upon this application.
